This Agreement is drawn up pursuant to Law No. 4077 on Consumer Protection as amended by Law No. 4822, and the Regulation on Distance Contracts, to regulate the mutual rights and obligations between the Consumer who orders the product(s) specified below from www.morenosilk.com and the Seller, the owner of the said website.

Article 5) General Provisions
Persons under the age of 18 may not shop on www.morenosilk.com. By confirming this Agreement electronically, the Consumer declares that they are over 18 years old.

The Seller shall not be held responsible for price or content errors arising from typographical or system-related issues on www.morenosilk.com. The Seller reserves the right to cancel orders containing incorrectly displayed prices.

By shopping on www.morenosilk.com, the Consumer accepts that the purchase is for personal use and not for resale.

By confirming this Agreement electronically, the Consumer acknowledges that they have received accurate and complete information that must be provided prior to concluding distance contracts, including the Seller’s address, telephone details, essential product features, prices including taxes, and payment and delivery information. If the product price is not paid or is cancelled in bank records for any reason, the Seller is deemed released from the obligation to deliver the product.

For orders placed by bank transfer or EFT, the processing date is not the order date, but the date the payment is confirmed to have reached the Seller's bank account. The Consumer accepts that if payment is not completed within 3 business days, the Seller may cancel the order.

If payment is made by credit card or similar payment card, and the bank or financial institution refuses to pay the Seller due to unauthorized use of the Consumer’s card after delivery, the Consumer must return the product to the Seller within 3 days, provided it was delivered to them.

Article 6) Obligations of the Seller
The Seller shall fulfil the order within 30 days from the moment the Consumer submits the order. This period may be extended by up to 10 additional days if the Consumer is informed in writing beforehand.

The Seller cannot be held responsible for failure of delivery due to issues encountered by the shipping company during delivery.

The Seller cannot be held responsible if the recipient at the delivery address refuses to accept the product.

The Seller may, for justified reasons, provide the Consumer with a product of equal quality and price before the performance period expires.

If the ordered product becomes impossible to produce for various reasons and the Seller is unable to fulfil contractual obligations, the Seller shall notify the Consumer before the performance period expires and refund all payments and return all documents within 10 days.

The Consumer has the right to withdraw from the Agreement within 7 days following delivery of the product to themselves or the designated recipient. To exercise this right, the Consumer must notify the Seller via the communication form, e-mail, or telephone provided on www.morenosilk.com, and the product must not fall under Article 7 – Products for Which the Right of Withdrawal Cannot Be Used. The Seller may refuse returns made without prior notification.

The Consumer or third party must return the invoice, delivery note, certificates, insurance forms, product box, packaging, and all accompanying documents and materials completely and undamaged. VAT and legal charges will not be refunded for returns missing the original invoice. Any damage or loss of value occurring during return shipment shall be the Consumer’s responsibility.

The product price shall be refunded to the Consumer within 7 days following receipt of these documents.

Article 7) Products for Which the Right of Withdrawal Cannot Be Used
The Consumer may not exercise the right of withdrawal for products customized or produced specifically upon Consumer’s request. Therefore, products engraved or modified to the Consumer’s specifications fall under this category.

Article 8) Competent Courts
In the implementation of this Agreement, Consumer Arbitration Committees up to the value announced by the Ministry of Industry and Trade and Consumer Courts located in the residential areas of the Consumer or Seller have jurisdiction.

Upon completion of the order, the Consumer is deemed to have accepted all terms of this Agreement.
